A Central Framework for Online Gaming Sector: A Welcome Proposal

In December 2022, the Indian government considered the concerns and woes of the online gaming sector and allocated the matters relating to online gaming to the Ministry of Electronics and Information Technology (“MeitY“). This step was taken by the Indian government to designate MeitY as an uniform administrative authority to supervise and regulate the online gaming sector and to enable consideration of issues related to online gaming in totality.

Subsequent to the above, MeitY issued the draft amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 to provide for a regulatory framework for the online gaming sector (“Proposed Framework”).  The Proposed Framework aims at ensuring that online games are offered in conformity with Indian laws and that the interests of the users of such online games are adequately safeguarded.
