FCC Regulatory Fees? Not Without Clear Authority

On Monday (7/18), a non-profit, non-partisan technology policy think tank filed reply comments at the FCC in response to a Notice of Proposed Rulemaking (NRPM) regarding the assessment of annual regulatory fees—the fees imposed on licensees that fund the FCC’s operations.

For TechFreedom, the focus was on the question of whether the FCC should adopt “new regulatory fee categories” on non-licensees that nonetheless “benefit” from the FCC’s regulatory efforts.

Its answer? No way.

The comments are eye-opening, as the NAB seeks to squash a double-digit percentage rate hike for licensed broadcasters — an increase it says is being done to account for the very entities TechFreedom believes to be exempt from regulatory…
